Terms and Conditions

1. Satisfaction Guarantee Every purchase from our website is covered by a 30-day satisfaction guarantee. We offer a full refund for unopened goods in their original, saleable condition. To return goods, please follow our Shipping and Returns Procedure.

2. Order Accuracy We guarantee that you will receive exactly what you ordered, with no substitutes or shortages. Larger orders may be shipped as multiple parcels.

3. Proofing and Design Services

   Most of our products include design services within the product price. This means we will take your artwork and requirements to create a design layout for your desired product. We typically allow for a short design process, including a couple of revision cycles with the customer. If the design process exceeds the standard revision cycles, we reserve the right to charge additional fees for further design work, or to cancel the order if the customer is not prepared to pay for the extra time.

   All designs created by Hoopsy are copyrighted to us. We retain ownership of all artwork created for customers in order to facilitate reprints or future orders. Should you wish to obtain these designs for use elsewhere, we reserve the right to charge a fee for their release. Additionally, customers have the right to request the deletion of any files or artwork that were specifically created for them by Hoopsy.

   All packaging designs, specifically box die designs, created by Hoopsy remain copyrighted to us. We may provide customers with design templates, but only after an order has been placed and paid for. Any folding-carton packaging box designs custom-created by Hoopsy may be used in other Hoopsy products unless a customer specifically requests exclusive use. If a customer requests exclusivity, we cannot guarantee that other manufacturers may not use the same design. Furthermore, we reserve the right to charge an additional design fee for any packaging designs that are intended to remain exclusive to the customer.

4. Delivery We aim for fast and cost-effective delivery. Orders are typically shipped via Royal Mail tracked services, but shipping methods may vary depending on the size, weight, and destination of the order. Larger orders may be dispatched as multiple parcels, and alternative couriers may be used at our discretion to ensure timely delivery.

5. Personal Information By placing an order, you agree to us storing your personal data provided during the checkout process. This data will only be used to complete your order and is not shared with any third party unless required for order fulfillment. Your data is securely retained in accordance with our Privacy Policy.

6. Availability All items are subject to availability. If any item you ordered is out of stock, we will notify you as soon as possible, offering you the option of delivery of available items or cancellation of your order.

7. Third-Party Services We may occasionally use third-party services to produce some of our products. These services are selected based on our quality standards.

8. Trademarks and Copyright If your design includes any trademarked or copyrighted material, you must have the necessary permissions to use them. Hoopsy reserves the right to refuse to print any material that we deem inappropriate, offensive, or in violation of copyright or trademark laws.

9. Information Accuracy Product specifications and details are provided either by the manufacturer or from publicly available sources. While we strive to ensure accuracy, we cannot guarantee the complete reliability of third-party information.

10. External Links Our website may contain links to third-party sites. We are not responsible for the content or availability of external sites and do not endorse them unless otherwise stated.

11. Prices and VAT Prices listed are what you pay. Hoopsy is not VAT registered, so no VAT is charged on your purchases. We reserve the right to adjust prices without prior notification.

12. Order Cancellation You may cancel your order in accordance with your rights under the Distance Selling Regulations. To cancel, contact us within 7 days of delivery, quoting your Order Number. Cancellations must be made before dispatch to receive a full refund. If the product packaging is opened, returns may not be accepted. Hoopsy reserves the right to cancel any order at any time or to cease working with a customer at any time. In cases where we have already shipped any part of the order, we will not request the return of the shipped items. However, we will refund any portion of the order that has not yet been produced or shipped.

13. Refund Policy Refunds will only be issued upon the return of goods in their original condition. For personalised items, refunds are not available unless the error is ours. Any undelivered orders that are returned to us due to non-responsiveness will be refunded, excluding delivery charges. Refunds will be processed within 30 days of receiving the returned goods.

14. Colour Reproduction and Consistency
    As a digital printer, the colours in your design may not exactly match the colours in the final printed product. This is due to differences in colour profiles, such as artwork supplied in RGB versus the CMYK colour model used in printing, as well as variations in individual colour intentions. While we make every effort to ensure the best possible colour reproduction, we cannot guarantee that colours will be identical to those seen on screen.

    Additionally, we cannot guarantee that subsequent reprints will be exactly the same as previous orders, although we do our best to ensure colour consistency across print runs. In cases where there are issues related to colour reproduction, we reserve the right not to offer a full refund.

15. Faulty or Incorrect Goods In the event that you receive faulty, damaged, or incorrect goods, please follow our Return Policy & Procedure. Faulty products identified after 30 days will be addressed under the Manufacturer’s Guarantee or Warranty. Please note that postage costs for returning faulty goods will not be reimbursed unless agreed.

16. Payments Payments can be made via PayPal, credit card (processed securely by Stripe), or bank transfer. For bank transfers, your order will be placed on hold until the funds have cleared in our account. All orders must be fully paid for before we will fulfill the order. Hoopsy does not hold, store, or process any credit card information. We take all reasonable precautions to secure your payment details; however, unless we are negligent, we cannot be held liable for any losses caused by unauthorised access to your payment information. Goods ordered and delivered by us remain the property of Hoopsy until fully paid for. We may transfer our rights under this agreement to third parties, including the collection of payments.

17. Liability Our liability is limited to the total value of the order placed. Hoopsy guarantees that goods are fit for their stated purpose, but we are not responsible for any indirect or consequential damages. We do not guarantee that our website will be fully compatible with your device and are not liable for any data loss or damage caused by its use.

18. Electronic Communication We will send regular communications regarding your order progress, including updates, dispatch information, and design proofs, directly to the email address you provide during checkout. It is your responsibility to ensure that the email address you provide is accurate and that the shop@hoopsy.co.uk email address is whitelisted to prevent our emails from being filtered into your spam folder. We are not responsible for delays or missed communication caused by email filtering, network issues, or incorrect email addresses.

20. Changes to Terms and Conditions We reserve the right to modify these Terms and Conditions without prior notice. Changes will apply to future orders only, and your statutory rights remain unaffected.
